Part A: Terms of Use

These Terms of Use ("Terms") govern your access to and use of pastmirea.com (the "Site") and the Past Mirea creative project, operated by Mirea Music ("Mirea Music," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

A.1 About Past Mirea

Past Mirea is an original creative project of Mirea Music. Content on the Site, including music, lyrics, artwork, videos, and related materials, is created using human-directed artificial intelligence tools as part of an ongoing exploration of AI-assisted art, storytelling, and music production.

A.2 AI-Generated Content Disclosure

Mirea Music is committed to transparency about the use of artificial intelligence in this project. The vocals, visuals, music, lyrics, and other creative content associated with Past Mirea, including its members Jesse Park, Cori Cho, Lexi Jung, and Anna Han, are created with the assistance of AI tools under human creative direction. These members are fictional, virtual personas and do not represent real individuals. This disclosure applies to all Past Mirea content published on the Site and across affiliated platforms unless otherwise stated.  

A.3 Intellectual Property Ownership

All content on the Site, including but not limited to music, lyrics, sound recordings, artwork, videos, the "Past Mirea" name and associated marks, and the overall look and feel of the Site, is owned by Mirea Music or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

A.4 Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and to stream or download purchased content for your personal, non-commercial use. You may not reproduce, distribute, publicly perform, publicly display, modify, create derivative works from, or otherwise exploit any content from the Site except as expressly permitted by these Terms or by separate written agreement with Mirea Music.

A.5 Content Use Authorization for Creators

Mirea Music welcomes engagement from content creators, including YouTube creators, who wish to feature Past Mirea music or videos in their own content. Any such use requires a separate, express Content Use Authorization from Mirea Music before publication. Unauthorized use of Past Mirea music, videos, artwork, or likenesses in third-party content, including reaction videos, remixes, or commercial use, is prohibited absent such authorization.

To request a Content Use Authorization, please contact us using the information at the end of this page. We aim to respond to Content Use Authorization requests within 10 business days.

A.6 Purchases

Digital Music: Digital music purchased through the Site is processed through Bandzoogle's integrated checkout system, using a third-party payment processor. By making a purchase, you also agree to Bandzoogle's own terms of service governing that transaction.

Merchandise: Physical merchandise is sold through our partner Fourthwall on a separate website, which uses its own third-party payment processor. Purchases of physical merchandise are fulfilled by Fourthwall, and that transaction is governed by Fourthwall's own terms of service, separate from these Terms.

All sales are subject to the applicable third-party platform's refund, cancellation, and fulfillment policies.

A.6A Age Requirements for Purchases

You must be at least 18 years old to make a purchase through the Site. If you are between the ages of 13 and 17, you are welcome to browse the Site and listen to sample content, but any purchase of digital music or merchandise must be made by, or with the direct involvement and consent of, a parent or legal guardian using their own payment method. By completing a purchase, you represent that you meet this requirement.

A.7 User Conduct

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, its systems, or related networks
  • Interfere with or disrupt the operation of the Site
  • Reproduce, scrape, or redistribute Site content in violation of Section A.4 above
  • Impersonate any person or entity, or misrepresent your affiliation with Mirea Music or Past Mirea
  • Create, upload, distribute, or use AI-generated, deepfake, or otherwise synthetic content depicting Jesse Park, Cori Cho, Lexi Jung, Anna Han, or any other Past Mirea persona in a manner not authorized by Mirea Music, or in any manner that misrepresents the source, endorsement, or affiliation of such content

A.8 Third-Party Links and Services

The Site contains links to and integrations with third-party services, including Bandzoogle, Fourthwall, Google reCAPTCHA, YouTube, Spotify, Apple Music, Amazon Music, YouTube Music, TikTok, and Instagram. We do not control and are not responsible for the content, privacy practices, or terms of these third-party services. Your use of any third-party service is governed by that service's own terms and policies.

A.9 Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

A.10 Limitation of Liability

To the fullest extent permitted by law, Mirea Music shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.

A.11 Indemnification

You agree to indemnify and hold Mirea Music harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

A.12 Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

A.13 Term; Suspension and Termination

These Terms remain in effect for as long as you use the Site. We reserve the right to suspend or terminate your access to the Site, or any account or feature associated with it, at any time and for any reason, including violation of these Terms, without prior notice. Sections A.3 (Intellectual Property Ownership), A.9 (Disclaimer of Warranties), A.10 (Limitation of Liability), A.11 (Indemnification), and A.12 (Governing Law and Venue) survive any termination of your access to the Site.

A.14 Copyright Complaints

If you believe that content on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act, 17 U.S.C. § 512, to our designated agent: Rynelle Alara at info@mireamusic.com. Notices should include the information required under 17 U.S.C. § 512(c)(3).

Part B: Privacy Policy

Mirea Music ("Mirea Music," "we," "us," or "our") operates the website pastmirea.com (the "Site") and the Past Mirea creative project. This Privacy Policy explains what information we collect when you visit or interact with the Site, how we use it, and the choices available to you.

By using the Site, you agree to the collection and use of information as described in this Privacy Policy.

B.1 Information We Collect

Information You Provide Directly

  • Contact Form: When you use the Contact page, we collect your name, email address, and the content of your message.
  • Mailing List: When you sign up for our mailing list, we collect your email address. This form is protected by Google reCAPTCHA to prevent spam and automated abuse; see Section B.4 below.
  • Purchases: When you purchase digital music through the Site, payment and order information is collected and processed through our website platform's checkout system and its payment processor. We do not directly collect or store your full payment card details.

Information Collected Automatically

When you visit the Site, our website hosting platform automatically collects certain technical information, which may include your IP address, browser type, device type, referring pages, and pages visited, through standard site analytics and functional cookies. We do not currently use Google Analytics, Meta Pixel, TikTok Pixel, or similar cross-site advertising or tracking tools on the Site.

Cookies

The Site uses cookies placed by our website hosting platform for core site functionality, such as maintaining your session and enabling secure form submissions. We do not currently use cookies for cross-context behavioral advertising or for selling personal information. If this changes in the future, we will update this page accordingly.

B.2 How We Use Your Information

We use the information we collect to:

  • Respond to your inquiries and messages
  • Deliver digital music you have purchased
  • Send occasional updates to mailing list subscribers about new releases and Past Mirea news
  • Operate, maintain, and improve the Site
  • Prevent fraud, spam, and abuse
  • Comply with applicable legal obligations

We do not sell your personal information, and we do not use your information for cross-context behavioral advertising.

B.3 How We Share Your Information

We do not sell your personal information to third parties. We may share information only in the following circumstances:

  • Service Providers: We share information with third-party service providers who help us operate the Site and fulfill your orders, described in Section B.4 below.
  • Legal Reasons: We may disclose information if required to do so by law, or if we believe such action is necessary to comply with legal process, protect our rights, or protect the safety of others.
  • Business Transfers: If Mirea Music is ever involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change via this page.

B.4 Third-Party Services

The Site relies on the following third-party services, each of which is governed by its own privacy policy and terms — we encourage you to review them:

  • Website Platform (Bandzoogle): The Site is built and hosted on Bandzoogle, which also processes digital music purchases through its integrated checkout using a third-party payment processor. When you make a purchase, that transaction is governed by Bandzoogle's own privacy policy and terms, in addition to this Policy.
  • Merchandise (Fourthwall): Physical merchandise is sold through our partner Fourthwall on a separate website, using its own third-party payment processor. Purchases of physical merchandise are fulfilled by Fourthwall, whose privacy policy and terms govern that transaction. We do not receive or process your payment information for merchandise purchases.
  • Google reCAPTCHA: Our mailing list signup form uses Google reCAPTCHA to prevent spam. Google may collect certain technical and usage data as part of this service, governed by Google's own privacy policy.
  • YouTube: We embed music videos hosted on YouTube. Viewing an embedded video may involve data collection by YouTube/Google under their own privacy policy.
  • Streaming and Social Platforms: The Site links out to Spotify, Apple Music, Amazon Music, YouTube Music, TikTok, and Instagram. Each of these is a separate service governed by its own privacy policy, and your use of them is subject to their terms, not ours.

B.5 Children's Privacy and Minors' Online Safety

 

This Section describes how we handle personal information of visitors under the age of 18 in light of the federal Children's Online Privacy Protection Act ("COPPA") and the California Age-Appropriate Design Code Act ("CAADC"). Because Past Mirea is a music project likely to be of interest to teenage fans, we recognize that the Site may be accessed by minors, including children under 13, even though the Site is not specifically directed to children and we do not target advertising to anyone.

Children Under 13 (COPPA)

We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent, and we do not condition a child's participation in any activity on the disclosure of more personal information than is reasonably necessary. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly. A parent or guardian who believes we may have collected personal information from their child under 13 may contact us using the information at the end of this page to review, correct, or request deletion of that information, or to refuse further collection or use of it.

Minors Under 18 (California Age-Appropriate Design Code)

For visitors we know or have reason to believe are under 18, we:

  • Apply high-privacy default settings as the Site does not offer public profiles, messaging, or social features to any visitor, and we do not use precise geolocation;
  • Do not use the personal information of minors for targeted or cross-context behavioral advertising, and do not sell or share it, consistent with Sections B.2 and B.3 above;
  • Do not profile minors by default;
  • Do not use dark patterns designed to lead a minor to provide more personal information than is reasonably necessary, or to weaken or turn off privacy protections;
  • Present privacy-related choices, including our mailing list signup and contact form, in plain, age-appropriate language rather than legal jargon wherever possible; and
  • Extend the same rights to know, access, delete, and correct personal information described in Section B.6 to minors and to their parents or guardians acting on their behalf.

We are continuing to evaluate our practices as the CAADC's requirements are clarified through ongoing litigation and regulatory guidance. If you are a parent or guardian with questions or concerns about a minor's use of the Site, please contact us using the information at the end of this page.

B.6 Your Privacy Choices

Mirea Music is a small, independent project and does not currently meet the statutory thresholds that trigger the full obligations of the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). However, as a matter of practice and respect for our visitors, we voluntarily extend the following choices to all visitors, regardless of location:

  • Right to Know/Access: You may request a copy of the personal information we hold about you.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions (for example, information we are required to retain for legal or accounting purposes).
  • Right to Correct: You may request that we correct inaccurate personal information we hold about you.
  • Right to Opt Out of Sale/Sharing: Not applicable — we do not sell or share personal information for cross-context behavioral advertising.
  • Non-Discrimination: We will not discriminate against you for exercising any of these choices.

To exercise any of these choices, please contact us using the information at the end of this page. We may ask you to verify your identity (for example, by confirming the email address associated with your request) before fulfilling it. We aim to respond to requests within 45 days.

B.7 International Visitors

The Site is operated from the United States, and any information you provide is processed and stored in the United States. If you are accessing the Site from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country. By using the Site, you consent to this transfer.

B.8 Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, respond to your inquiries, complete transactions, and comply with our legal obligations.

B.9 Data Security

We take reasonable measures designed to protect your personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

B.9A Email Marketing Choices

Every mailing list email includes a working unsubscribe link, and you may opt out at any time using that link or by contacting us using the information at the end of this page. We honor unsubscribe requests promptly and do not sell or share your email address, consistent with the federal CAN-SPAM Act.

B.9B Security Incident Notification

If we experience a security breach involving your personal information in a manner that triggers notification obligations under California law (Cal. Civ. Code § 1798.82) or other applicable law, we will notify you as required by that law.

Changes to This Page

We may update this Terms of Use & Privacy Policy page from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms and Policy.
